Terms and Conditions
These General Terms and Conditions (hereinafter referred to as “GTC”) are prepared in accordance with Act No. 108/2024 Coll. on Consumer Protection, as amended, and Act No. 40/1964 Coll. – the Civil Code, as amended. They form an integral part of the purchase contract and are governed by Act No. 102/2014 Coll. on Consumer Protection in Distance Selling and Off-Premises Contracts, as amended.

2. Definitions
2.1 Buyer
The Buyer is any natural or legal person who has placed an order, primarily via the Seller’s website or other means of distance communication (e.g. email, contact forms).
2.2 Consumer
A Consumer is a natural person who does not act within the scope of their business activity or profession when concluding and performing a consumer contract.
2.3 Online Store (Website, E-shop)
The online store is a computer system enabling the creation of orders without the physical presence of the Buyer. These GTC apply to the sale of goods via the website www.forensickmusic.com, as well as related domains www.forensick.sk and www.forensick.cz.
2.4 Goods
Goods are all products offered for sale through the online store. Both the Seller and the Buyer are bound by the price stated in the online store at the time the order is placed.
3. Goods and Their Characteristics
3.1 Product photographs and images in the online store are for illustrative purposes only. Actual colors, dimensions, print quality or product details may slightly differ depending on the device, lighting conditions or printing process. Such differences are not considered defects.
3.2 Textile products (T-shirts, hoodies, etc.) may differ in cut and size within a tolerance of several centimeters depending on the manufacturer. Sizes provided are for informational purposes only.
3.3 The type of textile (Gildan Heavy Cotton / Gildan Softstyle / Fruit of the Loom, etc.) may differ from the information stated in the product description.
3.4 For audio and video media (CD, LP, DVD), the appearance of packaging or booklets may differ depending on the edition or reissue. Such differences are not grounds for a complaint.
3.5 Information on product availability is indicative only. Availability is confirmed after the order is processed. If a product is unavailable, the Buyer will be contacted, usually by email.
3.6 Limited editions or handmade products may contain minor production deviations that are a natural characteristic of the product and do not constitute a defect.
3.7 Category images are illustrative and may not represent products currently in stock.
4. Order and Payment Terms
4.1 By submitting an order, the Buyer confirms that they have read and agreed to these Terms and Conditions. Without such confirmation, the order cannot be placed. Orders are made via the online order form.
4.2 By submitting an order, the Buyer makes a binding offer to conclude a purchase contract. The purchase contract is concluded upon acceptance of the order by the Seller.
4.3 The Buyer is responsible for the accuracy and completeness of the information provided in the order.
4.4 The Seller reserves the right not to accept or to cancel an order if the ordered goods are unavailable. The Buyer will be informed of this fact.
4.5 The Buyer is obliged to accept the ordered goods and pay the agreed purchase price, including delivery costs, in the manner specified in the order.
4.6 If the Buyer has previously failed to accept a shipment and did not respond to attempts by the Seller to make contact, the Seller reserves the right to require advance payment for future orders until incurred costs are settled.
4.7 If the Buyer pays in advance but fails to accept the shipment or refuses delivery and subsequently requests a refund, the Seller is entitled to deduct delivery and return shipping costs.
5. Warranty and Complaints
5.1 Warranty conditions are governed by the Civil Code. The warranty period is 24 months unless stated otherwise and begins on the date the Buyer receives the goods. Proof of purchase must be retained.
5.2 The warranty does not cover normal wear and tear, mechanical damage, improper use or incorrect handling.
5.3 The right to withdraw from the contract does not apply to audio and video media (CD, LP, DVD) if the protective packaging has been broken. Opened media may only be claimed in the case of a manufacturing defect.
5.4 The Buyer must inspect the shipment upon receipt. If the packaging is damaged, this must be addressed with the carrier and recorded. Later claims for transport damage may not be accepted if the shipment was accepted without reservation.
5.5 In the event of a defect, the Buyer must submit a complaint without undue delay by email or in writing.
5.6 The claimed goods, together with proof of purchase and a description of the defect, must be sent to:

5.7 The Seller will confirm receipt of the complaint without undue delay and state the period within which the complaint will be resolved.
5.8 Complaints will be handled no later than 30 calendar days from the date they are submitted, unless the law provides otherwise.
5.9 If a complaint is rejected, the Seller shall provide the Consumer with written justification.
6. Rights Arising from Liability for Defects
6.1 In the case of a removable defect, the Buyer has the right to free repair or replacement, provided this does not result in disproportionate costs.
6.2 In the case of an irremovable defect preventing proper use, the Buyer has the right to replacement or withdrawal from the contract.
6.3 Repeated defects or a larger number of defects entitle the Buyer to the same rights as in the case of an irremovable defect.
6.4 If the defect does not prevent use, the Buyer is entitled to a reasonable discount on the purchase price.
7. Exchange, Returns and Order Cancellation
7.1 Orders may be cancelled before dispatch by email or phone without any cancellation fee.
7.2 Exchange of non-defective goods (e.g. size change) is possible within 7 working days of receipt, provided the goods are unused and in original condition.
7.3 Exchanges do not apply to opened audio or video media (CD, LP, DVD).
8. Consumer’s Right to Withdraw from the Contract
8.1 The Consumer has the right to withdraw from the contract without stating a reason within 14 calendar days from receipt of the goods.
8.2 The right of withdrawal may be exercised in writing or by email sent to the Seller’s contact address.
8.3 The Consumer must return the goods within 14 days of withdrawal. The goods must be undamaged, used only to the extent necessary to determine their characteristics and functionality, and in original condition.
8.4 The Seller will refund all payments within 14 days of receiving the withdrawal notice, using the same payment method unless agreed otherwise.
8.5 The cost of returning goods is borne by the Consumer unless the law provides otherwise.
8.6 The right of withdrawal does not apply to goods exempt by law, in particular audio and video media if the protective packaging has been broken.
8.7 The Consumer is liable for any reduction in the value of goods caused by handling beyond what is necessary to determine their nature and functionality.
8.8 If goods are returned damaged, incomplete or excessively used, the Seller is entitled to reduce the refund proportionally.
9. Alternative Dispute Resolution (ADR / ODR)
9.1 If the Consumer is dissatisfied with the handling of a complaint, they may contact the Seller to request remedy.
9.2 If the Seller rejects the request or does not respond within 30 days, the Consumer may submit a proposal for alternative dispute resolution.

10. Final Provisions
10.1 Legal relations between the Seller and the Buyer are governed by the laws of the Slovak Republic.
10.2 Matters not governed by these Terms and Conditions are subject to applicable provisions of the Civil Code and related legislation.
These Terms and Conditions enter into force on 1 January 2026.
